IND adjusts procedure for applications for journeys in connection with family reunification on the part of minors

​As of now, minor foreign nationals with a residence permit may again apply for the travel regime in connection with family reunification [nareisregeling], even if they are being cared for in the Netherlands by an adult family member. State Secretary Broekers-Knol explained so in a letter to the House of Representatives*.

This decision puts an end to the procedure whereby children living with a family member in the Netherlands since 2019 have been proactively proposed to convert the application for the travel regime in connection with family reunification into an application for family reunification under Article 8 ECHR.

A survey carried out at the request of the State Secretary showed that more children could be affected by this way of working than expected. Moreover, the casuistry appears to be so diverse that a more individual assessment of the applications is appropriate, said the State Secretary. The IND will now only apply this working method when the term 'single' is not applicable.

Reassessment possible

Where necessary, the IND will offer those parties who have been unable to claim the right to travels in connection with family reunification in the past period under the aforementioned working method to have their original applications for the travel regime concerning family reunification handled.
